In Pakistan’s Judiciary, Islamic Notions of Justice are being used to Implement Un-Islamic Laws

On 7 April 2019, the Chief Justice of Lahore High Court, Justice Sardar Muhammad Shamim, addressed judicial officers who have completed their course at the Punjab Judicial Academy and said that, “Doing justice is the characteristic of Allah swt and Allah swt has granted us this characteristic.....verdict based on justice is better than praying thousand years and if some judge does not perform justice in any case than he will be answerable in this world and Hereafter”.

No doubt establishing justice is of great importance in Islam. Whilst giving a verdict in a case in which a woman of a noble family was prosecuted for theft, RasulAllah (saaw) said, وَاللَّهِ لَوْ كَانَتْ فَاطِمَةُ لَقَطَعْتُ يَدَهَا “If my daughter had committed theft I would have cut her hand as well.” The Chief Justice of LHC used the concepts of Islam in order to describe the importance of justice. However, he has omitted the reality that whilst Islam orders a judge to decide a matter without considering who is wealthy or poor, powerful or weak, Islam mandates that a judge decides a matter only according to the law which has been revealed by Allah (swt) because only then justice will be delivered. Allah (swt) said,

(وَمَنْ لَمْ يَحْكُمْ بِمَا أَنزَلَ اللَّهُ فَأُوْلَئِكَ هُمْ الظَّالِمُونَ)

“And whosoever does not judge by that which Allah has revealed, such are the unjust oppressors.” [Surah Al-Maida 5:45]. This Ayah of Quran clearly manifest that if a judge decides a matter with a clear conscience, but according to the laws of 1935 Act which were left by the British, or made by people sitting in Parliament, than he will not be establishing justice, rather according to Islam it will be called an oppression.

The basic reason of oppression in the society of Pakistan is that the constitution of Pakistan is not from the Quran and the Sunnah. The courts also implement the same un-Islamic constitution, instead of rejecting it. It is because of this constitution that a sincere man who performs Jihad or support Jihad financially against America in Afghanistan and India in Occupied Kashmir is declared a "terrorist" and jailed. However, when the rulers of Pakistan implement the interest based capitalist system and lie to the Ummah, this constitution still declares them as “Sadiq” (Truthful) and “Ameen” (Trustworthy). Those people who expose the treachery of rulers and their friendship with the colonialists, and raise their voice for the implementation of the Khilafah system in Pakistan, are being handcuffed and placed behind bars. However, the judiciary of this country grant legal basis to those rulers who surrender this Ummah to its enemies and fulfill their demands. The courts of Pakistan seriously enquire from former rulers about their financial corruption and strictly warn them, but they never account them for military cooperation and intelligence sharing with America. These courts consider the abrogation of the constitution a crime, but never asks rulers about their failure to implement Islam or their transgression of the commands of Islam. All this is happening because the judicial system of Pakistan considers an act a crime if it is decided as such by the secular capitalist system, not by the Islam. Justice will only prevail in Pakistan when the constitution of Pakistan is derived from Islam alone, with laws made from the Quran and the Sunnah, through the correct process of Ijtihad, rather than made upon democracy, freedoms, human rights and international laws constructed by the West.

Pakistan’s Ailing Economy Can Only be Cured by Abolishing Democracy and Re-Establishing the Khilafah

A report published by World Bank (WB) recently has said that Pakistan’s economic growth in the financial year 2019 is expected to be 3.4 percent. This report has also said that in 2020 the total economic growth will be down to 2.7 percent and that will be the lowest in the last eight years. The report was published this week, whilst the United Nations and Asian Development Bank (ADB) have already mentioned the sorry state of Pakistan’s economy in their respective reports. Despite abundant capabilities and resources, the sorry state of Pakistan’s economy is because of the capitalist system and the ruling elite that has been sucking the blood of Pakistan for the last seventy years.

The new government, which came into power upon the rhetoric of change, has followed the instructions of the IMF as the previous regimes used to do, which has halted the wheels of the economy. The massive depreciation of the Rupee with respect to the Dollar and the substantial increase in the price of electricity and gas, has opened the flood gates of inflation, which has broken the back of common people. Therefore the purchasing power of people has dropped and consequently demand has dwindled, which has further crippled the economy. As far as the business sector is concerned, the huge devaluation of Rupee, increased ithe cost of production, whilst concessions given to foreign companies has shattered the confidence of the local business man, which has effected production in every sector of the economy, from the service sector to large scale manufacturing. This is the reason that every report and expert opinions are depict the sorry state of Pakistan’s economy. This sorry state of the economy is not just because of the PTI regime, rather it is the result of every regime which came in power in the last seventy years. Each regime has pushed the economy of Pakistan to a new rock bottom level because all of them implemented capitalist economic system which sucks the blood of the people, concentrates wealth in a few hands and chokes the economy through colonialist policies forwarded by the IMF, WB and US Treasury Department.

The only solution to the ailing economy of Pakistan is the rejection of the capitalist system and the re-establishment of the Islamic Khilafah. Islam mandated that the currency of the state must be based on gold and silver which results in the end of rampant inflation. RasulAllah (saaw) ordered Muslims that they must use gold Dinar, weighing 4.25 gram, and Silver Dirham, weighing 2.975 gram, as the currency of the state. This law ensured that prices remained stable in the Khilafah state for over a thousand years. Therefore, currency based on gold and silver will protect the people from inflation and restore the confidence of business people. Islam prohibited the privatization of public properties, therefore natural resources and oil, gas and electricity producing units remain public property. Revenues generated through public properties are spent on the people and the state ensures this has to happen which further decreases inflation. The private sector will receive the inputs of raw materials, electricity, oil and gas at affordable rates, which will enable them to produce more at lower costs. Furthermore the Khilafah will not beg for interest based loans. Instead, it will lead a campaign against Western colonialist loans and move global public opinion against this oppression. It is this oppressive system which prevents numerous countries from standing on their own feet. This system mandates conditions upon loans which strangle the economy. Therefore under the Khilafah, Pakistan and the whole world will see prosperity, which was once the hall mark of the regions governed by Islam. Before the occupation of the British, the GDP of the Indian Subcontinent was 23 percent of the global GDP, but today it is drowning in poverty. Allah (swt) said,

(وَابْتَغِ فِيمَا آتَاكَ اللَّهُ الدَّارَ الآخِرَةَ وَلاَ تَنسَ نَصِيبَكَ مِنَ الدُّنْيَا وَأَحْسِنْ كَمَا أَحْسَنَ اللَّهُ إِلَيْكَ وَلاَ تَبْغِ الْفَسَادَ فِي الأَرْضِ إِنَّ اللَّهَ لاَ يُحِبُّ الْمُفْسِدِينَ)

“But seek, through that which Allah has given you, the home of the Hereafter; and [yet], do not forget your share of the world. And do good as Allah has done good to you. And desire not corruption in the land. Indeed, Allah does not like corrupters.” [Surah Al-Qasas :77].

Occupied Kashmir will be Liberated by Pakistan’s Armed Forces, not Major World Powers

Barrister Sultan Mahmood Chaudhry, former prime minister of Azad Jammu and Kashmir and senior leader of the Pakistan Tehreek-i-Insaf, said on 7 April 2019 that major world powers, including the United States and the European Union, were now, more than ever, interested in the resolution of the Kashmir dispute between Pakistan and India.

It is not a matter of celebration that major world powers are taking interest in the resolution of the Kashmir conflict. The history of the current world powers has proved that when they take interest in any issue, when it involves Muslims, they do not resolve it on the basis of justice. Instead, they seek their interests, harming Muslims as a result. The Muslims of Pakistan and Kashmir have not forgotten the conflict of East Timor, where major world powers separated a part of Indonesia, because most of its population was non-Muslims. Thus, they weakened a Muslim country. The Muslims of Pakistan and Kashmir have not forgotten the issue of South Sudan, where major world powers severed a large part of Sudan, because most of its population was non-Muslim. Thus they reduced the size of a Muslim country which was the largest Muslim country, by land area, in the world. The Muslims of Pakistan and Kashmir have not forgotten the role of major world powers over the issue of Palestine, where they remain silent over the atrocities of the Jewish entity against the Muslims of Palestine. Moreover they support the oppression. And the Muslims of Pakistan and Kashmir have not forgotten the role played by the major world powers over the conflict in Kashmir, where they assured the Muslims of Kashmir seventy years ago that they will be given an opportunity to decide whether they want to become part of Pakistan or India. However, until today that assurance has not been fulfilled. Instead, they support the state terrorism of Hindu state.

Therefore, the character of major world powers is based on hostility, deception and conspiracy. Placing hope in the major powers is like living in a fool’s paradise and those who do this deliberately are traitors.

The Muslims of Pakistan and Kashmir will be delighted when a sincere political and military leadership buries the policy of “restraint” and “normalization” in the River Jhelum and Neelum and orders Pakistan’s armed forces to wage Jihad for the liberation of Occupied Kashmir. However, the current political and military leadership of Pakistan will never take such an intelligent and brave decision, as its masters are sitting in Washington, who will never allow them to mobilize Pakistan’s armed forces for the liberation of Occupied Kashmir. Only a Khaleefah Rashid will take such a bold path as his Master will be Allah (swt) alone and he will only follow His (swt) commands. And then the Khaleefah Rashid, in obedience to the command of Allah (swt), will order the mightiest army of the Muslim World to wage Jihad for the liberation of Occupied Kashmir and on that day the Muslims of Pakistan and Kashmir will really rejoice.

(وَيَوۡمَٮِٕذٍ يَّفۡرَحُ الۡمُؤۡمِنُوۡنَۙ * بِنَصۡرِ اللّٰهِ‌ يَنۡصُرُ مَنۡ يَّشَآءُ وَهُوَ الۡعَزِيۡزُ الرَّحِيۡمُ)

“on that Day shall the Believers rejoice- With the help of Allah. He helps whom He will, and He is Exalted in Might, Most Merciful.” [Surah ar-Rum 4-5]
